Object of agreement

This agreement governs the sale of new jewellery items through the Brigitte Adolph online shop. For details of the respective offer, reference is made to the product description of the offer page.

Conclusion of contract

The contract is concluded exclusively in electronic commerce via the shop system. The displayed offers represent a non-binding invitation to submit an offer through the customer order, which can then be accepted by the Brigitte Adolph online shop. The order process for concluding the contract includes in the shop system
following steps:

  •     Selection of the offer in the desired specification (size, colour, number)
  •     Insert the offer in the shopping cart
  •     Press the button ‘order’
  •     Enter the billing and delivery address
  •     Selection of the payment method
  •     Review and processing of the order and all entries
  •     Click on the button ‘order now’
  •     Confirmation email that order has arrived

By sending an order confirmation, the contract is concluded. The automatically created and shipped
Order confirmation does not constitute a corresponding legally binding declaration. The contract also comes through with the sending of the goods or providing the service.

Retention of title

Until full payment, the delivered goods remain the property of the Brigitte Adolph online shop.

Prices, shipping costs, return costs

All prices are final prices, including VAT. When shipping within Germany, no shipping costs and Brigitte Adolph online shop carries the cost of legitimate return in the event of cancellation. Outside Germany, the buyer bears the return costs. The shipping costs outside of Germany and the delivery time extension to the delivery time specified in the product description can be found in the following table.

Terms of payment

The customer has only the following options for payment: PayPal and credit card, in some countries additional bill and immediate transfer via the payment service providers (PayPal and Klarna). All payment data is transmitted encrypted. Other payment methods are not offered and will be rejected.

When using a payment service provider, this allows the Brigitte Adolph online shop and customers to process the payment with each other. The payment service provider forwards the customer’s payment to the Brigitte Adolph online shop. Further information can be found on the website of the respective payment service provider.

When paying by credit card, the customer must be the cardholder.

Delivery terms

  1.     Option “buy directly online”
    The customer takes the delivery time from the respective offer description. The goods will be shipped after confirmed receipt of payment. Deliveries up to a value of 1000 € are made via DHL, for higher amounts UPS delivers. The customer will be informed about delays immediately.
  2.     Option “buy at the jeweller” (Germany and Austria)
    If the customer chooses to make a jewellery selection to a concessionaire and affiliate of Brigitte Adolph’s affiliate program, that means to have a the jewellery sent to a local jewellery store, the usual terms and conditions of the respective jeweller or dealer apply.

Warranty

Consumers are entitled to the offered services a statutory warranty liability according to the relevant provisions of the Civil Code (Bürgerliches Gesetzbuch, BGB). If this is deviated, the warranty is based on the regulations set out in the general Terms of Service (Allgemeine Geschäftsbedingungen, AGB).

Guarantees

The Brigitte Adolph online shop offers a 2-year warranty for material defects and processing errors. If a piece of jewellery shows defects in materials or workmanship under normal use, it will be repaired free of charge or replaced with another equivalent piece of jewellery. Proof of ownership is the proof of purchase.

Silver jewellery may become darker on contact with air, heat and moisture which is not a material defect. Follow the care instructions provided to keep the bright white of your silver jewellery as long as possible. Further information can be found in these terms and conditions under service and repairs.

Right of withdrawal

The consumer (§ 13 BGB) is granted a right of withdrawal according to § 355 BGB, which must be exercised within 14 days after receipt of the delivery. Excluded from exchange and return are special designs (for example individual ring sizes, jewellery with engraving).

You can revoke your contract within 14 days without giving reasons in writing (letter, e-mail) or – if the case before the deadline – by returning the goods. The period begins on receipt of this instruction in writing, but not before receipt of the goods at the recipient and not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To maintain the cancellation period, the timely dispatch of the revocation or the jewellery is sufficient.

Consequences of the cancellation
In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered. If you can not give us back or give us the received performance as well as usages (eg use advantages) or only partially or only in a deteriorated condition, you have to pay us compensation. For the deterioration of the thing and for drawn uses, you only have to pay compensation if the use or the deterioration is due to a handling of the thing, which goes beyond the examination of the characteristics and the functioning.

The term “testing the properties and the mode of operation” means testing and trying out the respective goods, as is possible and customary in a jewellery shop, for example.

The return is free of charge for you within Germany. In all other countries, the return is at the expense of the buyer. Upon receipt of your cancellation, we will send you a return label for the return. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.

Assignment and pledge ban

Claims or rights of the customer against the Brigitte Adolph online shop may not be assigned or pledged without his consent, unless the customer has demonstrated a legitimate interest in the assignment or pledging.

Language, jurisdiction and applicable law
The contract is originally written in German and has been translated to English for communication. The further implementation of the contractual relationship takes place in German. It exclusively applies the law of the Federal Republic of Germany. For consumers, this applies only insofar as this does not restrict any statutory provisions of the state in which the customer has his domicile or habitual residence.

Severability clause

The invalidity of any provision of these Terms and Conditions has no effect on the validity of the remaining provisions.
