1. General Information

These Terms and Conditions (“Terms”) govern the sale of jewellery by Brigitte Adolph Jewellery Design (“we”, “us”) to consumers and businesses (“you”) via our website.

By placing an order, you agree to these Terms. German law shall apply, unless mandatory consumer protection regulations of your country provide otherwise.

2. Scope and Subject Matter

These Terms apply to all orders placed via our website. The subject of the contract is the sale of jewellery, including items in stock and items made to order.

3. Conclusion of Contract

  1. By submitting an order, you make a binding offer to purchase the selected products.
  2. The contract is concluded when we confirm your order or dispatch the goods.
  3. For custom-made, personalised or specially manufactured items, the contract is concluded only upon our written confirmation.  

4. Prices and Payment

  1.  All prices are stated in EUR and include VAT, unless otherwise indicated.
  2.  Information on delivery times and shipping costs can be found on our shipping page.
  3.  The following payment methods are available (availability may vary by country):       
    • Credit card (Visa, Mastercard, American Express)
    • PayPal
    • Klarna
    • Google Pay
    • Apple Pay  

  4.  Payment is due immediately upon placing the order, unless stated otherwise during checkout.
  5.  In the case of credit card payments, dispatch may be delayed by one business day due to administrative processing.  

5. Delivery

  1.  Orders are shipped from Germany or an EU warehouse to the delivery address provided.
  2.  Delivery times and shipping costs are available on our shipping page.
  3.  If an order contains multiple items, shipment will take place only once all items     are available, unless otherwise agreed.  
  4.  All shipments are insured and include tracking. Tracking details are sent by email.
  5.  The risk passes to the buyer upon delivery.

6. Right of Withdrawal / Cancellation

6.1 Right of Withdrawal for Consumers in Germany and the EU

Consumers with a delivery address in Germany or another EU member state have a statutory right of withdrawal of fourteen (14) days from the day they or a third party designated by them receive the goods. Further details are provided in the separate withdrawal policy.

6.2 Returns within Germany and the EU

  •  Free return shipping in the event of a valid withdrawal
  •  Returns must be insured and sent exclusively via the courier designated by us
  •  A return label will be provided after approval of the return request
  •  Items must be returned unworn, undamaged, complete and in their original packaging     (including jewellery box and documentation)  

6.3 Right of Withdrawal for Consumers Outside the EU

For consumers with a delivery address outside the European Union, we voluntarily grant a right of withdrawal of fourteen (14) days from receipt of the goods, unless mandatory national law provides otherwise.

  •  No entitlement to free returns
  •  Returns must be insured and sent via the courier designated by us
  •  Return shipping costs as well as any customs duties, taxes or import fees will be charged to the customer or deducted from the refund amount  

6.4 Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  •  Custom-made items
  •  Special orders
  •  Individually ordered sizes, shapes or colours
  •  Engraved jewellery
  •  Items made to order or modified on request
  •  Gift vouchers

6.5 Refunds

Refunds will be issued within fourteen (14) days after receipt and inspection of the returned goods, using the original method of payment. We reserve the right to refuse refunds if the goods show signs of wear, damage or deviations from the return conditions.

6.6 Unauthorised Returns

If items are returned without a valid right of withdrawal, we reserve the right to refuse acceptance or, subject to customer approval, return the goods at the customer’s expense.

7. Warranty / Defects

  1.  We warrant that the goods comply with statutory requirements at the time of delivery.
  2.  The customer must inspect the goods immediately and report any defects without delay.
  3.  Minor deviations in colour, size or shape that are typical of handcrafted jewellery     do not constitute a defect.  

8. Liability

  1. Our liability is limited to intent and gross negligence, except in cases of injury     to life, body or health.  
  2. We are not liable for slight negligence or indirect or consequential damages.
  3. Mandatory consumer protection rights remain unaffected.

9. Data Protection

Personal data is processed in accordance with our privacy policy and the GDPR.

10. Online Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

  • Governing law: German law shall apply, unless mandatory consumer protection     regulations provide otherwise.  
  • Place of jurisdiction: Germany, insofar as legally permissible.
  • Should any provision of these Terms be or become invalid, the remaining provisions     shall remain unaffected.
